The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe felt a moment of respite on Monday, as the tension sparked by the announcement of a new 28-point plan for ending the war appeared – temporarily – to have been defused. A Washington representative spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, Moscow made its countermove: another massive barrage of aerial bombardment on Kyiv.

The Pattern of Peace Talks and Military Action

The succession of conflicting incidents captured the harsh reality of the outgoing year. By day, diplomatic battles are waged: hopeful statements are released from various governments. Considerable effort is allocated on restraining certain initiatives. By night, the Kremlin brutally reminds the world that, for them, conflict continues to be the main instrument for achieving "settlement".

After-Dark Attacks

As military strikes developed into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was exposed. Ukraine is able to track rocket firings from Russian territory, a capability afforded by timely intelligence. From observation points, Ukrainian air force fighter jets that had been deployed to engage hostile guided weapons streaked across the sky – modern combat jets supplied to Ukraine by Western partners.

Soon thereafter, Kyiv's missile defense thundered: several firings deployed against a Russian ballistic missile. This was a modern interception technology at work, presumably provided by allied countries. Every launch creates sudden vibrations, shaking the windows. The brief panic quickly becomes resigned acknowledgment: possibly the approaching threat won't strike its target this time, protecting urban areas from catastrophe and further power outages.

Ongoing Risks

Soon after, a heavy machine gun opened up on a aerial vehicle somewhere nearby, part of a mobile-fire group – almost certainly allied-provided weaponry. Sadly, the shots failed to hit the enemy aircraft – it continued its flight toward its objective.

Periodically, this persisted until dawn. Kyiv greeted the daybreak reports: seven people killed, devastation and utility failures in multiple buildings as a result of the night's assault. As always, everyone still went about their day – enduring hostilities. But those 24 hours encapsulated Ukraine's vital need on international aid – a dependence that regional partners are evidently unprepared to fill in the immediate future.

Ineffective Peace Efforts

The comprehensive proposal from US administration generated strong feelings, controversy and profound anxiety – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and international summits.

Every new initiative from US leadership follows the same pattern: a negotiation push against Ukraine, which Kyiv, with allied governments, manages to fend off. They contain the crisis but never actually achieve victory. This cycle will, certainly, continue.

Strategic Calculations

It is convenient to criticize certain parties of persistently promoting Moscow's conditions. But that does not seem to be the entire situation. US administration operates on a premise understood by international relations experts: you cannot secure via talks what you have lost on the battlefield. The American government assumes that it is unfeasible to compel Moscow to relinquish the territory that it presently holds in Ukraine's occupied territories.

The challenge is that while recognising this factual reality, American administration does nothing to prevent Kremlin actions, through diplomacy or military means, from believing that the current condition will not evolve additionally in its favour in the coming year.

Conflicting Perspectives

Therefore, Russian leadership is confident that the clock favors them – that Ukraine and its partners are nearing depletion. Their incentive to accept conditions that does not give them the greatest potential benefit is virtually nonexistent. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's government remains supremely confident in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, progressively conceding civilians and areas but avoiding a entire defensive failure until situations evolve in its benefit.

Current Realities

Objectively, there are no actual prerequisites for a ceasefire. Now, personal considerations are becoming relevant: personal goals to mediate resolution and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to distance important partners, and on the other, to mobilize citizens around the national cause against any proposal Kyiv finds unacceptable, so that their focus does not switch to internal issues. And although their mission will now be considerably more difficult after latest incidents, it remains quite doubtful that this will change their overall approach.

These conflicting dynamics are driving the talks.

Summary and Prospects

It took a just a single week to terminate the suggested clauses of the latest plan. Aggressive and erratic handling of the matter by American leadership, opposition by Ukraine and the rest of Europe, along with soothing efforts of representatives, and finally, current information leaks, all achieved their purpose.

While new plans based on previous concepts are forthcoming, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off political attacks from Washington that are based on Russian demands and reflect particular unwillingness to alter the situation, if they maintain solidarity and strengthen their defence capabilities at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the predictable period, mainly require sustained allied backing.
